01-06-2021 – IMPORTANT INFORMATION REGARDING VAT TAXES IN EU COUNTRIES
Since July 1st of 2021, in agreement with new EU regulations, ecommerce companies from EU as AMIGAstore have to charge the established VAT taxes of the destination country (if this is an European Union member). This regulation does not affect non-EU member countries.
Therefore, from July 1st 2021 and if you order from a EU country, VAT charged to your order is no longer the souce country VAT, this will be the stablished VAT of your country.
Our web system will try to identify your country without log in and using your public IP information to show correct VAT values. But this is not 100% sure. Please log-in adding your presonal address to be sure you are watching right prices. Note when you ordering right Tax values of your country are included (if necessary) and any further actions are not necessary.

PRIVACY POLICY/DATA PRIVACY AND GENERAL TERMS AND CONDITIONS OF SALE
1 Scope of the Contract
These General Terms and Conditions apply to the sale of all AMIGAstore.eu products by telephone, e-mail or through its online store to professionals, COMPANIES, consumers, users or any other final recipient, to whom orders may be delivered within the Spanish territory and abroad in accordance with the provisions of clause 4 (international sales). The use by the customer of the services of the AMIGAstore.eu store presupposes, in any case, adherence to the General Terms and Conditions of Business in the version published by AMIGAstore.eu at the time of sending the order request, which is available to customers on the website. It is therefore advisable for the customer to read the General Terms and Conditions carefully before proceeding to place an order. Thus, if the customer through the website, in the shopping cart, chooses the option “I have read and accept the GTC”, it will be considered that he/she fully understands and accepts them. On the other hand, if the customer does not accept these General Terms and Conditions, the transaction shall be terminated and shall not entail the assumption of any obligation on the part of the customer. Once an order request has been placed through the website, the CUSTOMER will receive an e-mail message confirming that the Order request has been sent correctly. Together with the confirmation of receipt of the Order Form, a copy of these General Terms and Conditions will be delivered.
2 Prices, methods of payment, delivery, availability and product returns.
2.1 Pricing
The prices indicated on the screen next to each PRODUCT will be expressed in Euros and will include VAT (Value Added Tax). VAT will not be added in case of sales to companies located in EU countries and to customers from non-European countries. In the shopping cart appears the amount to be paid WITHOUT the corresponding VAT, which is detailed separately in the same cart, together with the shipping costs, if any. Shipping costs are NOT included in the price of the items as they will depend on the quantity of items selected and the place of delivery of the order. The shipping costs are visible at all times but once the order is confirmed you can choose between different modalities, and in any case they will be displayed with an explanatory note, before the CUSTOMER finalizes the order request. Bids shall be duly marked and identified as such. AMIGAStore.eu reserves the right to make, at any time and WITHOUT prior notice, the changes it deems appropriate, and may update products and prices daily depending on the market. The price applicable to the order request made by the CUSTOMER shall be the one stated at the time of acceptance of the General Terms and Conditions. Before CONFIRMING the order, AMIGAstore.eu reserves the right to notify the CUSTOMER of any price error in the order, with the CUSTOMER having the right to cancel the order request if the final price is very different from the one initially indicated, reimbursing, if necessary, the amount paid and offering alternative possibilities that satisfy the customer. Prices for international sales shall be governed by the provisions of Clause 4 (International Sales). Shipping costs for destinations other than mainland Spain and the Balearic Islands are defined, although they may vary depending on the volume of the items included in the order request and specific requirements for international shipments. In this case AMIGAstore.eu Customer Service will contact the USER to notify him/her and request authorization to process the order request under the new conditions.
2.2 Methods of payment
All purchases resulting from the acceptance by AMIGAstore.eu of an Order Form may be paid by bank transfer to any of the bank accounts provided by AMIGAstore.eu. The user, if he/she so wishes, may pay for his/her purchase in advance, at the time of sending the Order Form, using PayPal. In this case the CUSTOMER accepts that PayPal will charge his/her card in advance the amount indicated in the Shopping Cart. For security reasons, in case the personal data provided on AMIGAstore.eu are different from the data appearing on the PayPal account used for the payment, AMIGAstore.eu reserves the right not to accept the payment and may cancel the Order Request, if it has doubts that the buyer is not the holder of the PayPal account used. The CUSTOMER may cancel any ORDER REQUEST prior to final confirmation of the purchase ORDER. If the ORDER has already been confirmed, by e-mail or by any other means of communication, the provisions of section 2.4 of these General Terms and Conditions shall apply.
The CUSTOMER can pay cash on delivery, as long as the shipment is made within Spain or Portugal.
In this case, the CUSTOMER will have to pay a 5% handling fee to the Nacex transport agency; and the shipping by post will be increased by 1.85€ for the same concept.
2.3 Deliveries and availability
2.3.1 Goods always travel carriage paid, i.e. they will be charged on the invoice itself.
Orders will be shipped the same day they are placed, as long as they are placed before 17:00h and paid through paypal or cash on delivery. Orders paid by bank transfer will be shipped as soon as payment is made.
a) Orders destined for the Peninsula and Portugal will be shipped through the transport agency Nacex and delivered the next day, are insured against loss and breakage.
b) Orders to the Canary Islands and Balearic Islands can be shipped by Nacex or Correos.
Nacex Canarias/Baleares – Delivery in 24/48h includes insurance.
Correos Canarias/Baleares – Delivery in 8/10 days not including insurance.
c) Orders to Europe can be shipped by Nacex or Correos.
Nacex Europe – Delivery varies by country and ranges from 2-6 days, including insurance.
European Post – Delivery varies by country and takes 6-10 days, insurance is not included.
d) Orders to non-European countries will be shipped by Correos and delivery varies according to destination.
For orders of less than 15,00€ the customer can choose the option of shipping by Correos Bajo Coste, in this case the package travels by registered mail without tracking number and without insurance. This mode is designed for orders that include magazines such as Amiga Future or low-cost items.
2.3.2 Upon receipt of the goods by the customer it will be necessary, for the purpose of possible claims against the transport agency, to note on the delivery note of the carrier any incident that may exist in the state of the goods or in the packaging of the same. The incident must be communicated by fax within 24 hours of receipt. Otherwise, the Transport Agency may consider that the product has been accepted. * For insured shipments.
2.3.3 Upon receipt of the goods, and provided that any of the events listed in point 2 have not occurred, the Customer shall check that the delivery is complete and not defective. If after 7 days from receipt of the goods, the buyer does not make any complaint, the goods shall be deemed to have been accepted for all purposes.
NOTE: AMIGAstore.eu will facilitate as far as possible any necessary procedures between the customer and the carrier, as well as mediate with the carrier for the resolution of any dispute.
2.4 Returns
If you are not satisfied with the product you have purchased, in accordance with European legislation, you have 14 days to return it, starting from the day you received it.
2.5 Warranty and claims
The warranty of the items marketed by Amigastore.eu is the one provided by the manufacturer, normally 1-2 years for private users as provided by the revised text of the Law for the Defense of Consumers and Users and Other Laws. The warranty of some consumables (consumables for printers, spare lamps, batteries, etc.) will be limited to the period of its useful life, which will be indicated by the manufacturer (3, 6, or 12 months), the warranty of second hand items will be 1 year as provided by the revised text of the Law for the Defense of Consumers and Users and Other Laws. Specifically, when the CUSTOMER wants to exercise his right to warranty, he may choose between the repair or replacement of the good (unless one of these options is impossible or disproportionate), or the termination of the contract, all under the terms and conditions set forth in the legislation of guarantees of consumer goods and other regulations applicable in your case. Amigastore.eu shall be liable for the lack of conformity of the good during the periods and under the conditions established by law. Similarly, the USER is subject to compliance with the requirements and deadlines provided by law for the exercise of these rights. In addition, Article 123.4 of the General Law for the Defense of Consumers and Users states that: “The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it.
2.5.1 All hardware items are subject to the warranty terms given by their respective manufacturers, within the provisions of current legislation. Please read the warranty terms for each product.
It is the customer’s responsibility to inquire about the compatibility of the purchased hardware with other hardware components or a given system. Amigastore.eu does not guarantee the hardware for these reasons, unless the invoice reflects the conditions of compatibility that the customer believes appropriate for the purchase of the same, previously raised to Amigastore.eu.
2.5.2 The defective material under warranty will always be sent prepaid to our technical service, detailing the anomalies detected in the material, accompanied by any manuals, diskettes and cables that were originally sent and accompanied by the requirements established by Amigastore.eu at all times, such as invoices, return form and RMA request.
2.5.3 In the case of software or audiovisual products, the warranty shall be void if they are unsealed. In all other cases, the warranty will be processed after our technicians confirm that the product has been handled and used correctly.
2.5.4 If a material is sent to our technical service without being found defective (for example because the customer has not been able to perform the correct installation and commissioning due to lack of the necessary knowledge), it will not be processed as a product under warranty, but as a technical service, in this case AMIGAstore will provide the customer with a quote, based on the rates for such service, which will include both the time spent by our technical service to test the material and the cost of sending it back to the customer.
2.5.5 The returned product under warranty will be repaired or replaced with a new product. If repair or replacement is impossible, the cost of the product will be reimbursed.
2.5.7 Amigastore.eu will provide Technical Support within the hours established for this function.
3. Protection of personal data
In compliance with the provisions of current legislation on Data Protection, the CUSTOMER is informed that the personal data requested through the web pages or other means, will be incorporated into the automated files for which Amigastore.eu is responsible, and will be subject to automated processing. In the event that the CLIENT provides his/her data to obtain information about Amigastore.eu products or services or for any other matter that does not generate a customer/supplier relationship, the data collection form will contain an authorization clause whose acceptance will mean that he/she gives his/her full consent to the automated processing of the data provided, in accordance with the Data Protection Law. It will be understood that you accept these conditions if you click on the “SEND” button on the data collection form, next to the consent clause. The information provided by the CLIENT will be used by Amigastore.eu exclusively for the following purposes: i) Sending the information expressly requested. ii) Periodic sending of information about the store, products or services of Amigastore.eu including the news that are produced with respect to them. In any of the above cases, once registered in the databases of Amigastore.eu, the CLIENT may exercise the rights of access, rectification, cancellation and opposition at any time, in accordance with current legislation. To exercise this right or obtain more information, the CUSTOMER can contact us at Amigastore.eu in calle Impresores, 5 30800 Lorca (Murcia) Spain or via mail: info@amigastore.eu In the case of purchases made with PayPal, Amigastore.eu may ask the CUSTOMER for some additional information such as sending by fax photocopies of your identity card and / or credit card.
4. International Sales
For all sales made outside the Spanish territory, the shipping costs corresponding to the weight and volume of the items ordered will be applied, as confirmed to the CUSTOMER before finalizing the order. In the event that the shipment was not correctly priced, the CUSTOMER once the order request is sent will receive via e-mail the correct cost of postage, at which time he/she must confirm the interest in the operation or otherwise it will be considered as not done. On the other hand, sales made by individuals domiciled in any of the EU countries will be subject to tax. Purchases made by taxpayers established in any of the EU countries will be exempt when they previously send a copy of a Tax Identification Number by any written means. Purchases made by individuals or legal entities residing in non-European Union countries, the Canary Islands or Ceuta or Melilla will be exempt from VAT: Any customs charges that may be incurred for the transport of products from the country of origin to the country of destination shall be borne by the Customer unless otherwise agreed. All the provisions of these General Terms and Conditions shall apply to international sales, unless any of its stipulations are contrary to the national legislation of the country of origin of the CUSTOMER.
5 Reservation of title
5.1 It is expressly established in favor of the CUSTOMER the reservation of title and ownership of the equipment and parts reflected in the invoice until the total amount has been paid in full. For the foregoing purposes, payment shall not be deemed to have been made when the same is instrumented by means of checks or checks and the same have not been effectively cashed.
5.2 The buyer accepts the conditions stated herein, as for the disagreements that may arise from the business deal, shall be as provided in the courts of the city of Lorca belonging to the Autonomous Community of Murcia, renouncing the buyer to any other jurisdiction or court that is not of this Autonomous Community.
